DRAFT — NOT YET IN EFFECT. REVIEW BY LEGAL COUNSEL BEFORE USE.
Training Waiver and Medical Release
Draft dated: October 2026
Please read this document carefully before your first in-person session with Hawley Rugby. It is a plain-language summary of what you are agreeing to. The headings below explain each section.
Who this covers
This waiver applies to all in-person rugby skills and strength training sessions provided by Colin Hawley, doing business as Hawley Rugby ("Colin"). It applies to the participant named at the time of booking ("Participant") and, where the Participant is under 18, to their parent or legal guardian who signs on their behalf ("Parent").
Understanding the risks
Rugby and strength training involve physical contact, running, jumping, tackling, and lifting heavy weights. These activities carry an inherent risk of injury, including but not limited to sprains, strains, fractures, concussions, and in rare cases more serious harm. By booking and attending a session, you acknowledge that these risks exist and cannot be completely eliminated, even with proper coaching and precautions.
Assumption of risk
You voluntarily choose to participate knowing these risks. You accept responsibility for any injury or loss that arises from the ordinary and known risks of rugby skills training and strength training, including injuries caused by your own actions, the actions of other participants present, or the nature of the activity itself.
Waiver and release of liability
To the fullest extent permitted by law, you agree to release, discharge, and hold harmless Colin Hawley and Hawley Rugby, their heirs, representatives, and successors, from any and all claims, losses, damages, or liability arising out of your participation in a training session — including claims arising from Colin's ordinary negligence.
This release does not apply to injury caused by gross negligence or intentional misconduct.
Indemnification
You agree to defend, indemnify, and hold harmless Colin Hawley and Hawley Rugby from any third-party claims, costs, or damages that arise from your participation in a training session.
Medical release and emergency care
You confirm that the Participant is in adequate physical condition to take part in rugby and/or strength training, and that you are not aware of any medical condition, injury, or illness that would make participation dangerous without medical clearance.
In the event of an emergency during a session where Colin is unable to reach a parent or guardian, you authorise Colin to consent to and arrange emergency medical treatment on behalf of the Participant. You agree that Colin will not be held liable for any medical treatment decisions made in good faith in an emergency.
You agree to notify Colin of any change in the Participant's medical condition or fitness level before any subsequent session.
Concussion and contact protocol
Hawley Rugby follows a conservative concussion protocol. Any Participant who shows signs of concussion during a session will be removed from activity immediately and will not return to training until they provide written clearance from a licensed medical professional. You agree to this protocol and to inform Colin of any prior concussion history before the first session.
Photo and video
Colin may photograph or video training sessions for his own professional records and, with your separate written consent, for use on hawleyrugby.com or social media. He will not publish images or video of a minor without prior written consent from a parent or guardian.
Governing law
This agreement is governed by the laws of the State of California. Any dispute arising from a training session shall be resolved in the courts of Sacramento County, California.
Severability
If any part of this agreement is found to be unenforceable, the remaining parts continue in full force.
Acknowledgement
By booking a session and attending training, you confirm that:
- You have read and understood this waiver.
- You are signing voluntarily and not under duress.
- If the Participant is under 18, you are their parent or legal guardian and have authority to sign on their behalf.
- You understand that this is a binding legal agreement.
